"HSE believe that risk management should be about practical steps to protect people from real harm and suffering - not bureaucratic back covering. If you believe some of the stories you hear, health and safety is all about stopping any activity that might possibly lead to harm. This is not the HSE's vision of sensible health and safety - they want to save lives, not stop them. The approach is to seek a balance between the unachievable aim of absolute safety and the kind of poor management of risk that damages lives and the economy".

The reality
The main legal duties lie with the employer, not the teacher - or even the head teacher, unless they own the school and employ the staff.
HSE have not found a single instance in the past five years of a teacher being personally sued for compensation. Over the years a handful of teachers have been prosecuted following very serious incidents, but only where they failed to follow direct instructions and departed from common sense.
Teachers who act responsibly will be on the right side of the law.
